TERMS OF USE, SUBMISSIONS AND REWARDING SCHEME

 

ACCEPTANCE OF TERMS 

The webpages available at www.b-places.com (b-places), and all linked pages ("Site"), are owned and operated by bluepill Group, accessed by you under the Terms of Use described below ("Terms of Use").

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THE SERVICES. BY ACCESSING THIS SITE OR USING ANY PART OF THE SITE OR ANY CONTENT OR SERVICES (AS EACH IS DEFINED BELOW) ON THE SITE, YOU AGREE TO BECOME BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO ALL THE TERMS AND CONDITIONS, THEN YOU MAY NOT ACCESS THE SITE OR USE THE CONTENT OR ANY SERVICES IN THE SITE. BLUEPILL GROUPS’ ACCEPTANCE IS EXPRESSLY CONDITIONED UPON YOUR ASSENT TO ALL OF THESE TERMS AND CONDITIONS, TO THE EXCLUSION OF ALL OTHER TERMS; IF THESE TERMS AND CONDITIONS ARE CONSIDERED AN OFFER BY BLUEPILL GROUP, ACCEPTANCE IS EXPRESSLY LIMITED TO THESE TERMS.

 

MODIFICATIONS OF TERMS OF USE

Bluepill Group reserves the right, at its sole discretion, to modify or replace the Terms of Use at any time without prior notification.

 

B-PLACES SITE SERVICES

 

DESCRIPTION OF SERVICE 

Subject to full compliance with the Terms of Use, bluepill Group may offer to provide certain services and content, as described more fully on the Site, ("Services"). Services shall include, but not be limited to, any service and content bluepill Group performs for you, as well as the offering of any materials displayed or performed on the Site (including, but not limited to text, comments, messages, information, data, graphics, news articles, photographs, images, illustrations, software, audio clips and video clips, also known as the "Content") on the Site. bluepill Group may change, suspend or discontinue the Services including any Content for any reason, at any time, including the availability of any feature or content. bluepill Group may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability.

 

SITE BEHAVIOUR CODE 

By inserting comments on the site you accept and commit yourself to abide by the Behaviour code set forth hereinafter. 

bluepill Group created the Behaviour code to provide guidelines as to what is and is not allowed on the site, in line with the following main principles. 
· Ensure a friendly atmosphere among the users 
· Ensure the privacy of users and others 
· Ensure compliance with existing laws 
· Encourage the freedom of speech and the exchange of information 

As a content contributor to b-places.com, you must participate responsibly. 

Please note that the Behaviour code only provides guidelines and that the list of violations set out below is not exhaustive. In case of any questions or uncertainties regarding the allowed use, please send us an e-mail for clarification before posting your comment. 

As a condition of use, you may not to use the Services for any purpose that is unlawful or prohibited by these Terms of Use, or any other purpose not reasonably intended by bluepill Group. By way of example, and not as a limitation, you agree not to use the Services:

· to abuse, harass, threaten, impersonate or intimidate other b-places users; 
· to contribute any Content that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive or otherwise violates any law or right of any third party; 
· for any illegal or unauthorized purpose. If you are an international user, you agree to comply with all local laws regarding online conduct and acceptable content; 
· to create or submit unwanted comments ("Spam"). Spam includes, but is not limited to, the following: 
o Excessive comments not related to the information posted 
o Posting nonsensical messages 
o "Flooding" b-places.com with similar meaning messages 
o Post-Count farming 
o Inciting a forum war or riot 
o Blatant advertising 
o Messages without content 

· to violate any laws in your jurisdiction (including but not limited to copyright laws); 
· to submit stories or comments linking to affiliate programs, multi-level marketing schemes, sites/blogs repurposing existing stories (source hops), or off-topic content; 
· with the exception of accessing provided RSS feeds, you will not use any robot, spider, scraper or other automated means to access the Site for any purpose without our express written permission. Additionally, you agree that you will not: (i) take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure; (ii) interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site; or (iii) bypass any measures we may use to prevent or restrict access to the Site; 
· with the intention of artificially inflating or altering the 'b-places ranking', comments count or any other b-places service for the purpose of artificially altering b;places' services; giving or receiving money or other remuneration in exchange for votes other than the rewarding scheme proposed by bluepill Group; or participating in any other organized effort that in any way artificially alters the results of b-places’ services. 

bluepill Group may remove any Content or comments at any time for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content), or for no reason at all. To report Terms of Use abuse, please send us an e-mail.

 

LOCATION SUBMISSIONS

 

AGREEMENT TO SUBMISSION POLICIES

In addition to these terms, if you submit a location for possible inclusion in b-places.com, you agree to comply with and be bound by the b-places submission policy below. 

b-places’ locations list is maintained by « Bluepill Group SL » (rue de namur,8 – 1000 Brussels – Belgium) who evaluate sites for inclusion in b-places. bluepill Group may reject, delete, or edit submissions that violate these policies or that bluepill Group otherwise believes, in its sole discretion, should not be included in b-places. bluepill Group may also reject, delete, or block other locations submissions that are believed to be associated with a user who has violated these policies.

 

LOCATION SUBMISSION POLICY:

· b-places has a policy against the inclusion of locations with illegal activities. Examples of illegal material include child pornography; libel; material that infringes any intellectual property right; and material that specifically advocates, solicits or abets illegal activity (such as fraud or violence).
· Do not submit pornographic locations
· Do not disguise your submission and submit the same location more than once.
· Do not submit locations "under construction." Wait until a location is complete before submitting it. Locations that are incomplete, aren't good candidates for b-places.

 

How to submit a location

To submit your Second Life location, click on "submit a location". Descriptions of locations should describe the content of the locations concisely and accurately.  Auto-submission software is (and always has been) a violation of this procedure. Locations submitted automatically are flagged and deleted after the submission is accepted, without notification to you. Persistent automatic submission may force us to ban you from b;places.

 

Procedure After Your location is submitted

The “Blue Pill group SL” will review your submission to determine whether to include it in b-places. Please only submit a location to b-places once. Again, multiple submissions of the same or related locations may result in the exclusion and/or deletion of those and all affiliated sites. Disguising your submission and submitting the same location more than once is not permitted.

 

Updating Your Site

If a site has been accepted for inclusion in b-places but you are dissatisfied with how the location is described or titled, you may send us an e-mail. Be polite and civil -- threatening or abusive behavior will not be tolerated. Please remember that we must exercise our discretion and make numerous judgment calls as to how to make b-places as useful as possible -- no matter what decision is made, we may not always satisfy everyone.

 

Editorial Discretion

Please recognize that making b-places a useful resource requires us to exercise broad editorial discretion in determining the content and structure of the site. That discretion extends (but is not limited) to what sites to include, where in the directory sites are placed, whether and when to include more than one link to a site, when deep linking is appropriate, and the content of the title and description of the site. In addition, a site's placement in the directory is subject to change or deletion at any time at our sole discretion. You should not rely on any aspect of a site's inclusion in the directory.  Please understand that an editor's exercise of discretion may not always treat all submissions equally. You may not always agree with our choices, but we hope you recognize that we do our best to make fair and reasonable decisions.

 

WARRANTY DISCLAIMERS 

You acknowledge that bluepill Group has no control over, and no duty to take any action regarding: which users gain access to the Site; what effects the Content may have on you; how you may interpret or use the Content; or what actions you may take as a result of having been exposed to the Content. You release b-places from all liability for you having acquired or not acquired Content through the Site. The Site may contain, or direct you to sites containing, information that some people may find offensive or inappropriate. Bluepill Group makes no representations concerning any content contained in or accessed through the Site, and bluepill Group will not be responsible or liable for the accuracy, copyright compliance, legality or decency of material contained in or accessed through the Site. 
THE SERVICE, CONTENT, AND SITE ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
LINKS 

The Services may provide, or third parties may provide, links to Second life sites or locations. Because bluepill Group has no control over such sites and locations, you acknowledge and agree that bluepill Group is not responsible for the availability of such external sites or locations, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or locations. You further acknowledge and agree that bluepill Group shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or location.

 

B-PLACES REWARDING SCHEME 

Voting

2 (two)  Linden Dollars (L$)  will be paid to the first 1000 Hot spot/b.place Voters per Vote. 
Every Friday at 18:00 the b-places.com HUD and Website will publish new resident suggested Hot spots/b-places and we are curious to see if you like them. 
Therefore we will reward you being among the first 1000 voters that vote on any Second Life b-places.com voting station.
Please note: you can only vote one specific Hot spot/b.place one time. Any other vote is not valid.
 
Please Note:
In case we notice any suspicious behaviour or attempts to manipulate the b-places reward system in any way and from any Avatar, we reserve the right to exclude you immediately from the rewarding scheme and from the b-places.com web site. For each incident we will file an abuse report to Linden Lab.

 

Claims for awards not credited

Please check the FAQ section of b-places.com web site first.
Only if you can not find the cause for the issue described in the FAQ report your incident.
 
In case you would like to inform us about any not credited claims for awards please contact send us an e-mail.
Please include the following information (mandatory) to report the not credited reward:
-exact Second Life incident time
-exact Second Life incident location
-name of passing Avatar
-name of the Receiving Avatar
-exact amount of L$ not credited
 
We will do our utmost to reward the voting of Hot spots/b-places on the b-places.com voting BOXES in Second Life according to our terms and conditions.
However we reserve the right to NOT reward anything to any Avatar for voting in case we have technical, platform related issues or fraud suspicion.

 

LIMITATION OF LIABILITY 

IN NO EVENT SHALL BLUEPILL GROUP SUPPLIERS BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR OTHER LEGAL THEORY (I) WITH RESPECT TO THE SITE, THE SERVICE OR ANY CONTENT FOR ANY LOST PROFITS OR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER, SUBSTITUTE GOODS OR SERVICES (HOWEVER ARISING), OR (II) FOR ANY DIRECT DAMAGES 

 

TERMINATION 

Bluepill Group may terminate or suspend any and all Services and HUD updates immediately, without prior notice or liability, if you breach any of the terms or conditions of the Terms of Use. All provisions of the Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

 

APPLICABLE LAW – COMPETENT COURTS

The present terms and conditions are subject to Belgian law, without giving effect to any principles of conflicts of law. Any dispute shall be submitted to the Brussels courts, which shall have sole jurisdiction.
